Privacy Policy

1. Information We Collect or Receive

In the course of operating the Platform, we will collect and/or receive the following types of information. You authorize us to collect and/or receive such information.

(a) Personal Information. We only receive or collect information that identifies you personally if you choose to provide such personally identifiable information to us. When you sign up to become a user, create or update your profile, post an event, RSVP to or check in to an event, apply for or accept a paid role, send or receive a payment, communicate with other users, or contact us, you will be required to (or may voluntarily) provide us with personal information about yourself (collectively, the "Personal Information"). Such Personal Information may include, without limitation, your first and last name, username, email address, physical or mailing address, phone number, date of birth, profile photograph, biographical information, emergency contact information, and any other information you choose to submit. We collect date-of-birth information at signup, and again at the time you seek to use any Paid Feature (as defined below), to enforce the age requirements described in Section 11. We do not collect Personal Information from you when you use the Platform unless you provide us with the Personal Information voluntarily or in connection with a feature you have requested.

(b) Account Sign-In and Device Authentication. At launch, you may create an account and sign in to the Platform using an email address and password or a one-time verification code sent to your email address. For your convenience, the App may allow you to use device-based biometric authentication (such as Apple Face ID or Touch ID) to unlock the App or re-authenticate on your mobile device. Any such biometric authentication is performed locally by your device's operating system, and we do not receive, collect, or store your biometric data or biometric identifiers. We may from time to time add additional sign-in methods, and if we do, we will update this Privacy Policy accordingly.

(c) User-Generated Content. The Platform enables you to submit, post, upload, publish, display, or transmit content, including event descriptions, photographs, videos, comments, messages, reviews, ratings, role postings, applications, and other materials (collectively, "User Content"). Information contained in or associated with your User Content, including metadata (such as time, date, and location of capture), the identities of persons you tag or mention, and the recipients of your communications, may be collected, stored, used, displayed to other users, and shared as described in this Privacy Policy and our Terms of Use. You should be aware that any User Content you make available to other users of the Platform or to the public may be viewed, collected, copied, and used by others outside of our control.

(d) Event, RSVP, and Check-In Information. When you post an event, browse or search for events, RSVP to or express interest in an event, save or bookmark an event or a cause, apply for or fulfill a paid role, or check in to an event using our GPS-based check-in feature, we collect information about your interactions with those events, causes, and roles. This may include, without limitation, the search queries and filters you use; the rallies, community events, and causes you view, save, bookmark, express interest in, RSVP to, or attend; the roles you post, apply for, are offered, or accept; the dates, times, and locations of such interactions; the identity of the organizer or attendee counterparties; your GPS coordinates and other geolocational data captured while you are actively using the App to check in and, where applicable, while the App is open and in the foreground during the duration of your attendance in a paid role; and the status and history of your event participation and role performance.

(e) Payment, Financial, Tax, and Identity Verification Information. It is anticipated that the Platform will enable a two-way payment flow in which event organizers ("Organizers") may fund events and pay users who fulfill paid roles (each such payee, a "Paid Role Recipient") as independent contractors, with Solivo retaining a platform fee. Payments will be processed by our third-party payment processor (including, but not limited to, Stripe/Stripe Connect) and its affiliates and other financial-services vendors (collectively, "Payment Providers"); Solivo will not itself receive, hold, or escrow user funds. To make available these features and to comply with applicable law (including anti-money laundering, know-your-customer ("KYC"), sanctions screening, tax, and consumer financial protection laws), we and our Payment Providers will collect the following categories of information (collectively, "Payment Information"):

(i) Payment Method and Transaction Data. bank account and routing numbers, credit card, debit card, or other payment card numbers, expiration dates, security codes, billing address and ZIP/postal code, ACH or wire information, digital wallet identifiers, payment tokens, transaction amounts, transaction descriptions, transaction history, dates and times of transactions, fees, refunds, chargebacks, disputes, and related metadata;

(ii) Identity Verification Data. your full legal name, date of birth, residential address, Social Security Number or individual taxpayer identification number (in whole or in part), Employer Identification Number, driver's license number or other government-issued identification number, images of government-issued identification, and other information reasonably necessary for our Payment Providers to verify your identity and eligibility to send or receive payments; and

(iii) Tax Information. information reasonably necessary to prepare, deliver, and file information returns and other tax filings, including IRS Forms 1099-NEC (for Paid Role Recipients treated as independent contractors), 1099-K (for Organizers or other payees, as applicable), and W-9, such as your taxpayer identification number, taxpayer name and address, transaction totals, and other tax-reporting data.

Payment Information will be collected, transmitted, stored, and processed by our Payment Providers in accordance with their respective privacy policies, terms of use, and applicable law. We generally do not receive or store full payment card numbers or full government-issued identification numbers on our systems; however, we may receive and retain limited transactional and verification data (such as the last four digits of a payment card, a payment token, verification status, transaction amounts, and dates) to operate the Platform, provide customer service, prevent fraud, and comply with applicable law. By providing Payment Information or using the payment features of the Platform, you acknowledge and agree to the collection, use, disclosure, and transfer of your Payment Information as described in this Privacy Policy and by our Payment Providers.

(f) Precise Geolocation Information. Certain features and core functionalities of the Platform depend on your precise physical location, including (i) discovering and browsing rallies, community events, and causes near you; (ii) receiving location-based notifications; (iii) completing our one-tap GPS check-in when you arrive at an event; and (iv) verifying, for Paid Role Recipients, that you were present at the event location and, where applicable, for the duration necessary to receive payment for a paid role. To provide these features while you are using the App, we may automatically collect precise geolocational information (including GPS coordinates, latitude and longitude, altitude, direction, speed, and cell-tower or Wi-Fi access-point information) from your mobile device, wireless carrier, and/or certain third-party service providers (collectively, "Geolocational Information"). With your permission granted through your device's operating system, Geolocational Information may be collected only while you are actively using the App and the App is open and in the foreground, to the extent permitted by your device settings and applicable law. You may decline or later disable the collection of Geolocational Information through your device settings; if you do so, we will not be able to provide certain location-dependent features or functionalities to you (including our one-tap GPS check-in, event-proximity discovery, and attendance verification necessary to receive payment for a paid role).

(g) Communications with Other Users and With Us. When you communicate through the Platform (including through in-App messaging, chat, comments, event walls, or by sending or receiving messages between Organizers and attendees or Paid Role Recipients), we collect and store the content of those communications, together with associated metadata (such as sender, recipient, date, time, and delivery status). We also collect and store the content of communications you send to our customer service, trust and safety, or other Solivo teams, including through email, SMS, phone, in-App forms, and support tickets. We may use, disclose, and retain such communications for the purposes described in this Privacy Policy, including to operate and improve the Platform, provide customer service, enforce our Terms of Use, resolve disputes, prevent fraud, and comply with applicable law.

(h) Other Information. In addition to the Personal Information, Payment Information, and Geolocational Information, we may automatically collect or receive additional information regarding you and your use of the Platform, your interactions with us and the Platform, and information regarding your computer and mobile devices used to access the Platform (collectively, the "Other Information"). Such Other Information may include:

(i) From You. Additional information about yourself that you voluntarily provide to us, such as your gender, pronouns, interests, event preferences, causes you support, skills or qualifications for paid roles, references, ratings and reviews of other users, and product and service preferences.

(ii) From Your Activity. We may collect or receive information regarding:

(A) IP address, which may consist of a static or dynamic IP address and will sometimes point to a specific identifiable computer or mobile device;

(B) Browser type and language;

(C) Referring and exit pages and URLs;

(D) Date and time of access;

(E) Details regarding your activity on the Platform, such as search queries, filters applied, events viewed or bookmarked, roles applied for, RSVPs, check-ins, in-App messages sent, and other performance and usage data; and

(F) Inferences drawn from the foregoing about your preferences, interests, characteristics, and behavior.

(iii) About Your Mobile Device. We may collect or receive information regarding:

(A) Type of mobile device;

(B) Operating system and version (e.g., iOS, Android);

(C) Carrier;

(D) Network type (e.g., Wi-Fi, 3G, 4G, 5G, LTE);

(E) Device identifiers, device settings, time zone, and language settings; and

(F) Camera, photo library, microphone, motion, and notification permissions and, subject to your permission, related content you elect to share with the Platform.

(iv) From Cookies and Similar Technologies. We may use both session cookies, which expire once you close the Platform, and persistent cookies, which stay on your mobile device or computer until you delete them, together with software development kits, pixel tags, web beacons, local storage, and similar technologies, to help us collect data and to enhance your experience with the Platform. We may use these technologies for various purposes, including to:

(A) Recognize the type of computer or mobile device you are using;

(B) Keep you signed in and remember your preferences;

(C) Personalize your experience and the content shown to you;

(D) Understand basic operational use of the Platform and improve its functionality;

(E) Maintain security and detect, investigate, and prevent fraud, abuse, and violations of our Terms of Use; and

(F) Comply with applicable law and protect the rights, property, and safety of us, our users, and others.

If you do not want us to deploy optional cookies or similar technologies, you can adjust your browser or device settings or use any consent-management tool we may make available. Some essential technologies are necessary to operate the Platform and provide requested features. Disabling cookies or similar technologies may affect your ability to use some features, including keeping you signed in or remembering preferences.

2. How Information is Used and Shared

We use your Information to provide, operate, maintain, secure, and improve the Platform and our services, including the features you request. We use your Payment Information to process your authorized payments through the Platform and to enable Organizers to pay Paid Role Recipients and other permitted payees. We share your Payment Information with our Payment Providers and other third-party service providers as necessary to facilitate, process, verify, settle, refund, or dispute your payment, to comply with applicable law, and to detect and prevent fraud. Our Payment Providers store your Payment Information subject to their own privacy policies and practices, which are not subject to the terms of this Privacy Policy. By providing your Payment Information or using the payment features of the Platform, you acknowledge and agree to the use of such information by our Payment Providers for these purposes.

(a) You authorize us to use the Personal Information, Payment Information, Geolocational Information, User Content, and the Other Information (collectively, the "Information") to:

(i) Create, provide, operate, maintain, personalize, and improve the Platform and our services (including event discovery, RSVPs, GPS-based check-in and attendance verification, ratings and reviews, messaging, and the paid-roles marketplace);

(ii) Facilitate, process, and record transactions between Organizers and Paid Role Recipients or other permitted payees, including funding events, paying Paid Role Recipients, refunds, chargebacks, and dispute resolution, and to calculate and collect Solivo’s platform fees;

(iii) Verify your identity and your eligibility to send or receive payments, comply with KYC, anti-money laundering, sanctions screening, consumer financial protection, and tax laws (including issuing and filing IRS Forms 1099-NEC, 1099-K, W-9, and comparable state tax forms);

(iv) Enable communications between you and other users of the Platform (including Organizers, attendees, and Paid Role Recipients) and display your profile, activity, and User Content to other users as appropriate to the Platform's functionality;

(v) Send you transactional, account-related, safety, service, and administrative communications, including confirmations, receipts, alerts, updates, notices of policy changes, and responses to your requests;

(vi) Send you marketing, promotional, and other non-transactional communications, including newsletters, offers, event recommendations, and information about our products, services, features, and partners, in each case subject to your ability to opt out where required by applicable law;

(vii) Personalize, tailor, recommend, and measure the content, features, offers, advertisements, rallies, community events, causes, and paid roles shown or recommended to you, including by analyzing the rallies, community events, causes, and paid roles you view, search for, save, bookmark, RSVP to, apply for, check in to, or attend, and by developing and refining models of your preferences, interests, and characteristics for these purposes, and conduct first-party advertising and marketing (subject to your consent or opt-out choices where required by applicable law);

(viii) Administer our promotional programs, contests, sweepstakes, referral programs, and surveys;

(ix) Solicit and process your feedback, ratings, and reviews;

(x) Detect, investigate, prevent, and respond to fraud, abuse, security incidents, and harmful, misleading, or illegal activity, and violations of our Terms of Use or other policies, and enforce our Terms of Use, community guidelines, and other agreements;

(xi) Perform internal operations, such as debugging, testing, research, statistical analysis, reporting, corporate governance, insurance, audits, financial reporting, and other business purposes;

(xii) De-identify, anonymize, or aggregate Information, which is no longer Personal Information, and use such information for the purposes permitted by this Privacy Policy and the Terms of Use; and

(xiii) Comply with applicable law, legal process, and lawful requests from public and government authorities, exercise or defend legal claims, and protect our rights, property, and safety and those of our users, employees, and the public.

(b) Sharing with Other Users. Solivo is an event and community platform, and certain Information is made available to other users of the Platform as an inherent part of that functionality. When you post an event, apply for or accept a paid role, RSVP, check in, send messages, or post User Content, information such as your username, profile photograph, biographical information, ratings and reviews, activity history, aggregate check-in status, and communications may be visible to Organizers, attendees, other Paid Role Recipients, and, in some cases, the general public. Organizers of paid roles may also receive information reasonably necessary to fulfill their obligations to you (including your legal name and payout confirmation) and to comply with applicable tax and payment laws.

(c) Service Providers. We engage third-party companies and individuals to perform functions on our behalf, including hosting, storage, cloud computing, communications (email, SMS, and push notifications), customer service, trust and safety, content moderation, payment processing, identity verification, tax reporting, security, insurance, accounting, legal, and other professional services. These service providers may access the Information only as necessary to perform their functions and are contractually required to protect it in a manner consistent with applicable law.

(d) Payment Providers, Identity Verification, and Tax Reporting. We share Payment Information and related Personal Information with our Payment Providers, identity verification vendors, tax-reporting vendors, banking partners, card networks, and other financial-services providers as necessary to enable, process, verify, settle, refund, or dispute payments; to open, maintain, or close payments accounts; to verify your identity; to detect and prevent fraud, money laundering, or terrorist financing; and to prepare and file required tax filings and reports.

(e) Marketing and Promotional Communications. We may send you communications about Solivo’s products, services, features, rallies, community events, causes, and paid roles, subject to applicable opt-out requirements. We may use service providers to deliver those communications on our behalf.

(f) Affiliates and Corporate Group. We may share some or all of your Information with any of our parent companies, subsidiaries, joint ventures, or other companies under common control with us, for use consistent with this Privacy Policy.

(g) Aggregated or De-identified Data. In an ongoing effort to better understand our users, the Platform, and our products and services, we may analyze certain Information in de-identified, anonymized, and/or aggregate form to operate, maintain, manage, secure, and improve the Platform and our products and services; conduct internal analytics; prevent and address fraud, abuse, and security incidents; comply with applicable law; and protect the rights, property, and safety of Solivo, our users, and others. Such data does not identify you personally. We may share such data with our service providers and affiliates only as necessary to support these purposes and subject to applicable contractual and legal restrictions, and may disclose such data when required by law or as necessary to protect the rights, property, and safety of Solivo, our users, and others. We do not sell, license, commercialize, monetize, or otherwise make such data available to any third party for independent commercial purposes.

(h) Business Transfers. As we develop our business, we may sell, buy, invest in, or otherwise participate in transactions involving businesses or assets. In the event of a corporate sale, merger, acquisition, reorganization, sale of assets, financing, bankruptcy, receivership, dissolution, or similar event (whether occurring or contemplated), the Information may be disclosed to advisors and counterparties and may be part of the transferred assets.

(i) Legal, Safety, and Compliance. To the fullest extent permitted by applicable law, we may also disclose the Information:

(i) When required by law, subpoena, court order, or other government, regulatory, or law enforcement authority or agency (whether within or outside your jurisdiction of residence);

(ii) To respond to national security or law enforcement disclosure requirements;

(iii) To enforce our Terms of Use, this Privacy Policy, or any other agreement between you and us, or to establish, exercise, or defend our legal rights or claims; and

(iv) Whenever we believe that disclosing such Information is necessary or advisable, for example, to prevent physical, financial, or other harm, injury, or loss; to investigate or address fraud or potential wrongdoing; or to protect the rights, property, or safety of us, our users, or others.

3. Rally-, Cause-, and Event-Related Content

Solivo is a platform for discovering and participating in rallies, community events, and causes. As a result, the events you view, save, RSVP to, attend, organize, or apply to work at, the causes you support, and the User Content you post or submit through the Platform (including comments, photographs, and messages) may reveal information that some U.S. state privacy laws characterize as "sensitive personal information," "sensitive data," or a similar term, including information that could indicate your political opinions or beliefs, religious or philosophical beliefs, union membership or activity, ethnic or racial origin, or membership in a protected class. By using the Platform, you acknowledge and agree that any such information you voluntarily provide, post, or share through the Platform (or that can reasonably be inferred from your event, RSVP, check-in, paid-role, or User Content activity) is provided by you at your own election, and you consent to our collection, use, and disclosure of that information for the purposes described in this Privacy Policy, including to operate the Platform, connect you with events and Organizers, and enable your participation in paid roles. We do not use such information to infer characteristics about you for purposes other than operating the Platform and providing our services, and we treat such information as "sensitive" only to the extent, and for the purposes for which, applicable law requires. You should exercise your own judgment about the information you post, share, or otherwise make available through the Platform, and about the events, causes, and roles in which you participate.

4. Communications, Text Messaging, and Push Notifications

(a) Email Communications. If you provide us with your email address, you agree that we may send you transactional, account-related, safety, service, and administrative emails, as well as marketing, promotional, and other non-transactional emails. You may opt out of marketing emails at any time by clicking the "unsubscribe" link at the bottom of any such email or by adjusting your preferences in your account settings; however, you may continue to receive transactional, account, safety, and other service-related emails.

(b) Text (SMS/MMS) Messaging. If you provide us with your mobile telephone number and opt in where required, you agree that we and our service providers may send you calls, autodialed calls, prerecorded messages, and SMS/MMS text messages, including for transactional, account, safety, event-related, marketing, and promotional purposes. Message frequency will vary. Message and data rates may apply according to your mobile plan. Consent to receive marketing text messages is not a condition of any purchase or of your use of the Platform. You may opt out of marketing text messages at any time by replying STOP to any such message (or by following the opt-out instructions provided in the message); you may also reply HELP to any such message for assistance. Even after you opt out of marketing text messages, we may continue to send you transactional and safety text messages related to your account, events, roles, or payments.

(c) Push Notifications. We may deliver push notifications to your mobile device (for example, to notify you about upcoming events, RSVPs, paid-role opportunities, check-in reminders, messages, and payments). You can disable push notifications at any time through your mobile device's operating system settings or in the App.

5. Accessing and Modifying Information and Communication Preferences

If you have provided us with any Personal Information, you may access, remove, review, and/or make changes to the same through your account settings (where available) or by contacting us as set forth in this Privacy Policy. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our subscription databases, in our archives, or in our service providers' systems. You cannot opt out of receiving transactional, account, safety, or other service-related communications related to the Platform (for example, confirmations, receipts, fraud alerts, and notices about material changes to this Privacy Policy or the Terms of Use).

6. Data Retention

We retain your Information for as long as your account is active, as long as reasonably necessary to provide you with the Platform and our services (including to develop, refine, and deliver personalized recommendations of rallies, community events, causes, and paid roles based on your activity over time), as necessary to comply with our legal, regulatory, tax, accounting, and reporting obligations, to enforce our agreements, to resolve disputes, and to protect the rights, property, and safety of us, our users, or others. When Information is no longer required for these purposes, we will delete, de-identify, or anonymize it, or, where deletion is not reasonably possible (for example, because Information has been retained in backup archives), we will securely store and isolate the Information from further processing until deletion is possible.

7. How We Protect Your Information

We take commercially reasonable administrative, technical, and physical steps to protect the Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties with which we may share such Information, nor can we guarantee that the Information you supply will not be intercepted while being transmitted over the internet or a wireless network. In particular, emails sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via email. In the event of a security incident affecting your Personal Information, we will notify you and applicable regulators to the extent required by, and in accordance with, applicable law.

8. Automated Decision-Making and Artificial Intelligence

We and our service providers may use automated processing, algorithms, machine learning, and artificial-intelligence-based tools to operate, personalize, and improve the Platform, including to recommend rallies, community events, causes, and paid roles to you based on your activity on the Platform, rank search results, moderate content, detect and prevent fraud and abuse, verify identity, evaluate applications for paid roles, calculate ratings, and perform internal operational analysis. We do not use your Personal Information for solely automated decision-making that produces legal or similarly significant effects concerning you without human involvement, except as expressly permitted by, and in accordance with, applicable law. Where required by applicable law, you may have the right to request human review of, or to object to, certain automated decisions; please contact us as set forth in this Privacy Policy.

9. Geographic Scope; Non-U.S. Residents

The Platform is offered by us to users located in the United States, and the Platform and its servers are operated in the United States. We do not intend to offer or market the Platform to, and do not knowingly permit registration by, residents of the European Economic Area, the United Kingdom, Switzerland, Canada, or any other jurisdiction outside the United States. If you are located outside of the United States, please be aware that your Information, including your Personal Information, may be transferred to, processed, maintained, and used on computers, servers, and systems located in the United States, where the privacy and data protection laws may not be as protective as those in your jurisdiction. If you are located outside of the United States and nonetheless choose to access or use the Platform, you do so on your own initiative and at your own risk, and you hereby irrevocably and unconditionally consent to such transfer, processing, storage, and use in the United States.

10. App Stores; External Websites; Third-Party Integrations

(a) Your app store (such as the Apple App Store) and the operating-system provider for your mobile device may collect certain information in connection with your use of the Platform, such as Personal Information, Payment Information, Geolocational Information, and other usage-based data. We have no control over the collection of such information by a third-party app store or operating-system provider. Any such collection or use is by that third party, not Solivo, and is subject to that third party's applicable privacy policies and terms.

(b) The Platform may contain links to, or otherwise interact with, third-party websites, applications, and services. For example, when you tap to obtain directions to an event, the App may open your device's native mapping application (such as Apple Maps or Google Maps), and any information collected by that mapping application is subject to its own privacy policy and terms; we do not receive or store the location, routing, or navigation data collected by such third-party mapping applications. We have no control over the privacy practices or the content of third-party websites, applications, or services, and we are not responsible for their content, privacy policies, or practices. You should check the applicable third party's privacy policy and terms of use before using or interacting with any such service.

11. Age Requirements; Children

The Platform is available only to users who are at least eighteen (18) years old (or, if higher, the age of majority in your state of residence). To create a general account and to browse, search for, save, RSVP to, or check in to events, causes, or other non-payment features of the Platform, you must meet this minimum age requirement. To post an event, post or fund a paid role, apply for or accept a paid role, send or receive a payment, or otherwise access the Platform's payment- or payout-related features (collectively, the "Paid Features"), you must also meet this minimum age requirement. To help us enforce this requirement, we collect date-of-birth information at signup and at the time you seek to use any Paid Feature, and we gate access to the Platform and the Paid Features based on that information. The Platform is not directed to children or other minors under the age of eighteen (18), and we adhere to the Children's Online Privacy Protection Act ("COPPA”) and other applicable privacy laws. We do not knowingly collect Personal Information from any person under the age of eighteen (18). Nothing in this Privacy Policy permits any person under the age of eighteen (18) to access or use the Platform. If we learn that a person under the age of eighteen (18) has provided us with Personal Information or is using the Platform, we may suspend or terminate that person’s account and delete or de-identify any associated Information as permitted by applicable law. A parent or legal guardian who believes that a child has provided us with Personal Information may contact us to request that such information be deleted from our records, and we will take commercially reasonable steps to do so. To the extent required by applicable law, a parent or legal guardian of a person under the age of eighteen (18) may contact us to request review, correction, or deletion of that person’s Personal Information. We do not knowingly sell or share the Personal Information of any person under the age of eighteen (18) for purposes of cross-context behavioral advertising, and we do not process the Personal Information of persons under the age of eighteen (18) for purposes of targeted advertising or profiling in furtherance of decisions that produce legal or similarly significant effects, in each case except as permitted by applicable law.

12. No Sale of Personal Information

Solivo does not sell your Personal Information for monetary consideration to any third party. We may disclose Information to service providers, Payment Providers, other users as part of the Platform’s functionality, professional advisers, parties involved in business transfers, and government and other authorities as described in Section 2; those disclosures are not advertising uses.

13. U.S. State Privacy Rights

This Section 13 supplements the other sections of this Privacy Policy and describes rights that may apply to you if you are a resident of certain U.S. states. Because we intend the Platform to be available to users throughout the United States, we extend the substantive rights described below to all U.S. users of the Platform, regardless of state of residence, subject to reasonable identity verification.

(a) California Residents (Shine the Light). We do not currently monitor, recognize, or honor general web browser "Do Not Track" signals, but we honor the Global Privacy Control ("GPC") signal as an opt-out of the "sale" or "sharing" of personal information to the extent required by applicable law.

(b) California Consumer Privacy Act (CCPA/CPRA). Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA"), "personal information" is any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household. In the preceding twelve (12) months, we have collected, used, and disclosed for a business purpose the categories of personal information described in Section 1, which map to the CCPA statutory categories of: identifiers; personal information categories listed in Cal. Civ. Code § 1798.80(e); commercial information; internet or other similar network activity; geolocation data; sensory information (photographs, audio, video); professional or employment-related information; inferences; and sensitive personal information (including account log-in credentials in combination with any required security or access code, precise geolocation, and, through our Payment Providers, government identifiers and financial account information). We use sensitive personal information only for the purposes permitted by the CCPA (for example, to provide the services you request, to detect security incidents, and to prevent fraud). Subject to certain exceptions, California residents have the right, up to two (2) times in every twelve (12)-month period, to: (a) request that we disclose the categories and specific pieces of personal information we have collected about them, the categories of sources, the business or commercial purposes for collecting, selling, or sharing personal information, and the categories of third parties to whom we disclose personal information; (b) request that we delete personal information we have collected from them, subject to certain exemptions; (c) request that we correct inaccurate personal information; and (d) opt out of the sale or sharing of personal information and of the use or disclosure of sensitive personal information for purposes other than those permitted by the CCPA. You have the right not to receive discriminatory treatment for exercising your CCPA rights. (c) California Eraser Law. To the extent required by applicable law, a California resident may request the removal of content or information that the resident has posted on the Platform under the California "Eraser Law" (Cal. Bus. & Prof. Code § 22581). To make such a request, please contact us as set forth in this Privacy Policy. Please note that removal will only be from those services under our control, and for privacy purposes we may ask you to verify your request. Removal of content does not ensure complete or comprehensive removal from the Platform or the internet.

(d) Nevada Residents. Nevada residents have the right to opt out of the sale of certain "covered information" for monetary consideration to a person for that person to license or sell such information to additional persons. To submit such a request, please contact us as set forth in this Privacy Policy.

(e) Other U.S. State Consumer Privacy Rights. Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, New Hampshire, New Jersey, Iowa, Tennessee, Indiana, Minnesota, Maryland, Kentucky, Rhode Island, Nebraska, and other U.S. states with comprehensive consumer privacy laws that are in force may have some or all of the following rights, subject to the requirements and exceptions of the applicable law:

(i) the right to confirm whether we process the resident's personal information and to access that personal information;

(ii) the right to obtain a copy of the personal information the resident previously provided to us in a portable and, to the extent technically feasible, readily usable format;

(iii) the right to correct inaccuracies in the resident's personal information;

(iv) the right to request deletion of the resident's personal information, subject to legal exceptions;

(v) the right to opt out of (A) the sale of personal information, (B) targeted or cross-context behavioral advertising, and (C) profiling in furtherance of solely automated decisions that produce legal or similarly significant effects;

(vi) the right to limit the use or disclosure of sensitive personal information where required by applicable law; and

(vii) the right to appeal our refusal to act on a rights request.

We will verify your identity before responding, and we will respond within the time period required by applicable law. If we decline to act on your request, you may appeal our decision by contacting us at the email address in Section 15 and including the words "Privacy Rights Appeal" in the subject line. We recognize the GPC as a valid opt-out mechanism for the sale of personal information and targeted advertising, to the extent required by applicable law.

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. Any such changes will be posted on the Platform, and, if the changes are material, we will provide notice through the App, by email, or by other reasonable means. By accessing or continuing to use the Platform after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by this Privacy Policy in effect at the time we collect the Information. Please refer back to this Privacy Policy on a regular basis.
